A federal judge has granted a motion to transfer the upcoming fraud trial of former Baltimore State’s Attorney Marilyn Mosby to Greenbelt. The decision was made on Friday following a renewed request from Mosby’s legal team.

At 43, Mosby, who held office from 2015 until 2023, faces serious charges including two counts of perjury and accusations of making false statements on a loan application. Prosecutors allege that she misrepresented her financial situation to access funds from her retirement account prematurely, citing the Coronavirus Aid, Relief, and Economic Security Act (CARES Act). Additionally, she is accused of providing false information regarding the purchase of two properties in Florida.

In the court documents submitted by her defense attorneys—Federal Public Defender James Wyda, Assistant Federal Public Defender Maggie Grace, and Lucius Outlaw—they argued that Mosby has been a “lightning rod” for controversy throughout her political career. They emphasized that her time in office was marked by significant media scrutiny, which they believe could hinder her ability to receive a fair trial in Baltimore.

The defense contended that the prosecution's approach is based on a “novel theory of perjury” that has not been previously pursued in other cases, and they expressed concerns about the potential bias of a Baltimore jury given the extensive negative press coverage surrounding Mosby for years.

As a result, her attorneys sought to have the trial moved from the Northern Division to the Southern Division of the District of Maryland, where they believe a more impartial jury could be found.
